One of the main responsibilities of your employer is to ensure your workplace is a safe environment. What does this mean and what should you do if you think you're being put at risk.

Both the employer and the individual are responsible for health and safety in the work place.


If you find something that isn't right it should be reported to your line manager who should then pass it on to the next step.If you feel nothing is being done then you take it to your health and safety rep who will action it.

Just a question, what do you do if you work in a very small firm, don`t have a rep. and no-one is interested in Health and Safety? Is there somewhere you can go?

Are you refering to H & S in the UK or in Germany.


If its Germany i personally can't answer your question not knowing their rules but im sure there must be someone who has the answers.

Are you refering to H & S in the UK or in Germany.


If its Germany i personally can't answer your question not knowing their rules but im sure there must be someone who has the answers.



I meant in the UK mate, I obviously don`t know the system and was just curious.

Hiya, I know its true about the employers and the individuals. This can be said as my work colleague in retail fell over and slipped on some unstudy ladder which they already knew was the case, he contacted ..........................McKeowns Solicitors UK</a> to get a compensation however he would have earned more if he just told his manager in the first place. I know this is something different but the same principles apply for what you are saying.

 But if also a OFFENCE not to report a Unsafe issue at work! ,  I am sure the first time you step onto a Gun Range,  You were given that long speech about the Health and Safety and the use of PPE and If they are available which I know they often are tons of and you choose NOT to,  Then the Employer can not be held legally liable to any damage that it may cause you in future such as Hearing Problems or Eye Damage or Skin protection.  and you as the employee or visitor is personelly liable. 


The problem also comes where If you feel you are doing something unsafe,  You as a employee as the RIGHT to say NO to the employer and explain why,  In which the Employer must find a other way or train you.  I understand in the military you just do as your told and most decent Officers/Generals will understand this and work with you and reps to make the workplace safe for all.


Such as today Somebody came to me to say They is a hose pipe going thru the wing,  In which I went there and was window cleaners cleaning the windows,  Under my job role I had to find a different way to get the hose to the front of building while also making it safe for


A) Contractors B) Staff C) Visitors/Public while doing this I also expended to bring this project within the agreed Budget and Timeline and Terms. 


For a small firm,  Anybody under 10employees do NOT have to comply with HSE at work Rules and Regs.  Anybody above 10 employees MUST and often a small firm H&S rep will be the owner or partner.  Also ANYBODY no matter if your employed there or not,  Can report Safety Issues to HSE and HSE will look into that case by case. 


Also I feel the above Solicitors were just doing some Free Plugging.
